    These Terms & Conditions ("Terms") govern your access to and use of the Makan platform, available on the web at mak-an.io and through our mobile applications (together, the "Platform"). The Platform allows you to discover events, buy tickets, and — for organizers — create events and sell tickets to attendees. By using the Platform, you agree to these Terms.

    1. Acceptance of Terms

    By accessing or using the Platform, creating an account, or purchasing a ticket, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree with these Terms, you must not use the Platform. If you use the Platform on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

    2. Definitions

    • Platform — the Makan website, mobile applications, and related services operated under the "Makan" brand.
    • User — any person who accesses or uses the Platform, whether as a Buyer, an Organizer, or a visitor.
    • Buyer — a User who purchases or reserves one or more Tickets for an Event.
    • Organizer — a User or entity that creates, lists, manages, and sells access to an Event through the Platform.
    • Event — any activity, experience, or gathering listed on the Platform by an Organizer, whether in person or online.
    • Ticket — a digital or physical proof of purchase that grants the holder a limited license to attend an Event, subject to these Terms and the Organizer's conditions.
    • Order — a completed transaction on the Platform through which one or more Tickets are purchased or reserved.
    • Venue — a bookable space or location listed on the Platform by an Organizer, offered for reservation through one or more Time Slots rather than as a scheduled Event.
    • Time Slot (Slot) — a named, individually-priced period of time defined by an Organizer during which a Venue may be booked (for example, "Morning Session" or "Evening Session").
    • Booking — a completed reservation of a specific Time Slot for a Venue, subject to real-time availability and, for seated Venues, remaining capacity.

    3. Accounts & Eligibility

    To purchase Tickets or create Events you may need to register for an account. You agree that:

    • You are of legal age to enter into a binding contract in your jurisdiction, or you have the consent of a parent or legal guardian.
    • The information you provide is accurate, current, and complete, and you will keep it up to date.
    • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
    • You will notify us promptly of any unauthorized use of your account or any other breach of security.

    We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unlawful purposes.

    4. Tickets & Purchases

    A Ticket represents a limited, revocable license to attend the specified Event; it does not transfer any other rights. When you purchase a Ticket, please note:

    • Tickets are valid only for the Event, date, time, and holder specified at the time of purchase.
    • Each Ticket is generally admitted on a one-scan basis: once a Ticket has been scanned for entry, it cannot be used again.
    • You must not duplicate, resell, or transfer Tickets except where expressly permitted by the Organizer and applicable law.
    • Guest checkout is supported for many Events, allowing you to buy Tickets without creating an account; you remain responsible for providing a valid contact email to receive your Tickets.

    5. Venue Bookings & Time Slots

    In addition to event Tickets, some listings on the Platform are bookable Venues rather than Events. A Venue Organizer publishes one or more named, individually-priced Time Slots — for example, "Morning Session" or "Evening Session" — each with its own price, which Users may reserve. When you make a Booking, please note:

    • You book a specific Time Slot for a Venue, and every Booking is subject to real-time availability; a Slot that has already been booked is unavailable.
    • Some Venues are seated with a limited capacity, so Bookings for them are constrained by the remaining seats or capacity; other Venues are booked as a whole Slot.
    • You may use the Venue only for the Time Slot and the purpose you booked, and you must comply with the Venue's rules and the Organizer's conditions.
    • No-shows are handled according to the Venue Organizer's stated policy.

    Payments, fees, cancellations, refunds, and rescheduling for Venue Bookings are handled in the same way as for event Tickets, as described in the sections below.

    6. Payments & Fees

    Prices are displayed in the local currency indicated at checkout and are set by the Organizer. These payment terms apply whether you are purchasing event Tickets or making a Venue Booking. When you complete an Order:

    • The total may include the ticket price plus any applicable service, processing, or platform fees, which are shown before you confirm payment.
    • Payments are processed through supported third-party payment gateways. By paying, you authorize the applicable charge to your selected payment method.
    • You are responsible for any taxes that apply to your purchase unless otherwise stated.

    We are not responsible for delays or failures caused by a payment provider, though we will make reasonable efforts to help resolve payment issues.

    7. Refunds, Cancellations & Rescheduling

    Refund eligibility is primarily determined by the Organizer's refund policy, which is set for each Event. The same approach applies to Venue Bookings, where cancellations, refunds, and rescheduling follow the Venue Organizer's stated policy. In general:

    • If an Event is cancelled by the Organizer, Buyers may be entitled to a refund of the ticket price, subject to the Organizer's policy and applicable law. Service or processing fees may be non-refundable.
    • If an Event is rescheduled, your Ticket will normally remain valid for the new date. Where a refund is offered for a rescheduled Event, it will follow the Organizer's stated policy.
    • Approved refunds are processed back to the original payment method used for the Order. Processing times may vary depending on your payment provider.

    If you believe you are entitled to a refund, please contact the Organizer or our support team.

    8. Event Entry & Conduct

    Admission to an Event is subject to presenting a valid Ticket and, where required, a matching form of identification. You acknowledge that:

    • The Organizer and venue reserve the right of admission and may refuse or revoke entry in accordance with their conditions and applicable law.
    • You must comply with all venue rules, safety instructions, and the lawful directions of Event staff.
    • Prohibited behavior — including harassment, violence, illegal activity, or conduct that endangers others — may result in removal from the Event without a refund.

    9. Organizer Responsibilities

    Makan operates as a marketplace and facilitator that connects Organizers with Buyers; Makan is not the host, producer, or operator of the Events or Venues listed on the Platform. Organizers are solely responsible for:

    • The accuracy and completeness of their Event or Venue listings, including dates, times, location, pricing, and descriptions.
    • Delivering the Event as advertised and honoring the Tickets they sell.
    • For Venues, ensuring the condition and availability of the Venue and honoring confirmed Bookings.
    • Setting and clearly communicating their refund, cancellation, and entry policies.
    • Complying with all applicable laws, licenses, permits, and tax obligations related to their Events or Venues.

    Organizers agree to indemnify Makan against claims arising from their Events or their breach of these Terms.

    10. Intellectual Property

    The Makan name, logo, brand, Platform, software, and all related content are owned by Makan or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform for its intended purpose. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Platform without our prior written permission. Content submitted by Organizers remains their responsibility, and they grant Makan a license to display it for the operation of the Platform.

    11. Privacy

    Your personal data is collected and processed in accordance with our Privacy Policy, which explains what information we collect, how we use it, and your rights. By using the Platform, you consent to the processing of your data as described in that policy. Please review it to understand our data practices.

    12. Limitation of Liability

    The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law:

    • Makan is not responsible for the conduct of any Organizer or Buyer, nor for the quality, safety, legality, or delivery of any Event or Venue Booking.
    • Makan is not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform or attendance at any Event.
    • Where liability cannot be excluded, our total liability is limited to the amount you paid for the relevant Order.

    Nothing in these Terms excludes liability that cannot lawfully be excluded.

    13. Changes to These Terms

    We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

    14. Governing Law

    These Terms are governed by and construed in accordance with the applicable laws of the jurisdiction in which Makan operates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved by the competent courts of that jurisdiction, unless applicable law requires otherwise.
